The Nazis didn't burn the Reichstag, although they quickly took advantage of it politically. Apparently they just didn't think of it.
From what I read, the communist who was arrested and charged with burning the Reichstag had in fact started a few fires in wastebaskets, but since the building was ignited with accellerants he was not the 'only' person trying to torch it.
