Title 37 NJ Code, MARRIAGES AND MARRIED PERSONS
The licensing officer shall issue the license which shall be obtained:
a. In the municipality of this state in which the female party to the proposed marriage resides; or
b. In the municipality in which the male party resides, if the female party is a nonresident of this state; or
c. In the municipality in which the proposed marriage is to be performed, if both parties are nonresidents of this state.
37:1-11. Illegal issuance of license a misdemeanor
Any licensing officer who issues a marriage license except as provided in this chapter shall be guilty of a misdemeanor.
37:2-3. Domicile of married woman
The domicile of a married woman shall be established by the same facts and rules of law as that of any other person for the purposes of voting, officeholding, testacy, intestacy, jury service and taxation.
