No, she does not; she can move the months DOWN considering some of the good things about Martha; contrition, as they are saying right now on Fox, MIGHT get her the BOTTOM range, but not probation. The numbers quoted on this thread already have the "down" factored into them. (Since she's neither contrite NOR admitting what she did, that's not going to help her.)

She's going to jail for at least ten months, with no chance of getting out for good behavior. There's not going to be any probation or community service for her.

Probation is not the same as a suspended sentence.

And yes, she does, the judge has the *discretion*, if not the inclination or reason, to give Martha probation.
