Situational? Of course. Sentencing should almost always be "situational". The harm caused is one factor that should affect sentence.


I've had Marthy's number since the early nineties.* Yes, yes, she's a mean bean. She doesn't belong in prison for
this particular fib, however.

In the next hour Fox is going to interview the K-Mart executive who put the deal together with Martha Stewart. This should be interesting!

Also, this evening Frank Kostyra, her brother, is going to be on one of the cable shows.

Hey, did you ever buy any of her merchandise? I bought some bath rugs that faded after two washings. On the ATRW thread Two-thirds had a teakettle that broke after 2 months, and duckbutt had towels that turned to lint!!

You wouldn't think so if you listen to all of Martha's friends on TV over the weekend; to a person, they STILL believe we are dumb and they are right, not to mention better than the rest of us.

Martha was great fun to Bill Cosby and Rosie O'Donut. She only duped and dumped on the little people in her employ. I know a woman who worked a while for her back in 1983. Martha had an increasing rep back then as a super homemaker for profit type. My friend worked in her herb garden

WoW! What a great idea! Martha Stewart could transform the prison ~ transform the prison system.

Stewart's ability to make stuff beauty out of elemental things, make the ordinary something very special; just like Chuck Coleson, this could be a transformation for Stewart that could put new life into her calling. She has already taken the suburban farm, family home, as far as it can go, this could be a great opportunity to take it to the next level, not just transforming a suburbanites life, but for those who never had anything. She has the no nonsense attitude to do it.

The judge still has a great deal of discretion in this case. He has the power and leeway under the law to inflict a range of punishments from probation to 5 years in prison.

I think she should get a prison term, and it should be suspended. On the low end, too - a year to sixteen months in the federal pen.

FWIW I am opposed to sentencing guidelines that remove judiciary discretion.

No, she does not; she can move the months DOWN considering some of the good things about Martha; contrition, as they are saying right now on Fox, MIGHT get her the BOTTOM range, but not probation. The numbers quoted on this thread already have the "down" factored into them. (Since she's neither contrite NOR admitting what she did, that's not going to help her.)

She's going to jail for at least ten months, with no chance of getting out for good behavior. There's not going to be any probation or community service for her.
