Pro-Family Law Center Files Legal Action to Remove California Attorney General Bill Lockyer and S.F. Mayor Gavin Newsom from Office;
Action Challenges Attorney General to Appoint Special
Independent Counsel Due to Conflict of Interest
The Sacramento-based Pro-Family Law Center (PFLC) today filed a legal action with the California Attorney Generals office, calling for the removal of the Attorney General himself, San Francisco Mayor Gavin Newsom and San Francisco City and County Clerk Nancy Alfaro for breach of their respective oaths of office. Since February 12th, Newsoms administration has been issuing marriage licenses to homosexuals in flagrant violation of state law. According to published reports, Attorney General Lockyer was given advance notice that Newsom intended to break state law in this manner but did not intervene to stop him, either before or after Newsoms illegal decree. City and County Clerk Nancy Alfaro assisted Newsom by illegally altering the official state marriage license forms and pledge.
Each official took an oath of office that states in pertinent part: "I
do solemnly swear (or affirm) that I will support and defend the Constitution of the United States and the Constitution of the State of California
; that I will bear true faith and allegiance to the Constitution of the United States and the Constitution of the State of California;
and that I will well and faithfully discharge the duties upon which I am about to enter.
It is the position of the Pro-Family Law Center that Newsom and Alfaros actions, and Lockyers complicity, constitute contempt for the rule of law and for the Constitutions they vowed to defend.
The legal procedure utilized by the PFLC in this action is called a Quo Warranto Petition. It is essentially a citizens demand upon the government to prosecute the illegal activity of another citizen. If the government declines to prosecute, the petitioning citizen gains the right to sue the offending party in civil court for a breach of the criminal law.
Ironically, a Quo Warranto Petition which is based upon a violation of state law must be filed with the Office of the Attorney General. In this case, since Attorney General Lockyer is both a material witness in two lawsuits against Newsom, and charged with complicity in the violation of the law, the PFLC has asked the Attorney General to appoint an Independent Counsel to handle this matter, or else to refer it to the Federal Attorney Generals office.
Scott Douglas Lively and Richard D. Ackerman of the firm Lively and Ackerman are representing the Pro-Family Law Center in this action.
Confidence in the rule of law is a most fundamental but fragile prerequisite of a democratic society, said Lively. By his reckless political experiment in civil rebellion, Mayor Newsom threatens the peace of the entire nation. He is a contemptuous scofflaw trying to cloak himself in the mantle of a civil rights crusader. Lockyer and Alfaro are nothing less than accessories before the fact.
Newsom, Lockyer and Alfaro have no power to alter California marriage laws in any manner, said Ackerman. Their blatant disregard for the law and the constitutional rights of the California people cannot be condoned. Justice demands that their actions be declared void and that they be removed from office.
If the Office of the Attorney General fails to take action on this complaint, the Pro-Family Law Center, on behalf of the citizens of California, will file action against the parties in civil court.
