Lockyer must either enforce the state law and anger his liberal base or do nothing and allow Arnold to keep him on the hot seat.

Is Arnold setting him up for a recall? Or is this just a chess move to check his campaign for governor in 2006?

That's an idea! Why not get recall petitions going for all the DemocRATS elected statewide. It could be called a Total Recall.
