Maybe the cops were having problems not with the condoms but the other part of his statement:

If he let them sleep in the same bed, then the issue is whether that in itself is a crime or just bad parenting. Can he be charged, for example, with aiding and abetting statutory rape? But simply allowing the guy to sleep at the house is not a crime
