Alex Polier was, as of 5pm Kenya time, hiding out in Nairobi. She and her fiance, Yaron (sp) Schwartzman were staying at the home of his parents Joseph and Hannah. The London Evening Standard reported last night that she was already in the UK. They were wrong, although there is a possibility she may have flown later on last night -- but I think it is more likely she was still here.

Alex and Yaron were moved from the family's palacial home in the upmarket Nairobi suburb of Lavington late last night to avoid the press. They could be anywhere in Kenya -- at the coast or on Safari.

Yaron is believed to work in Nairobi at a company called Film Struck Studios or possible Film Studios. The company is owned by daddy. He is believed to move in a circle of friends known as the "cokehead set". Now there is more than one cokehead set in Kenya, which attracts old wealth, new wealth, British Aristocracy and some of the international gliterrati.

Daddy is the chairman of an engineering company called H Young, which is owned by former cabinet minister Nicholas Biwott. Biwott is a nasty piece of work. Former President Daniel arap Moi's right hand man, a Scotland Yard enquiry named him the prime suspect in the 1990 murder of Foreign Minister Robert Ouko. He plundered the Kenyan treasury and is known here as "the Godfather", "Mr 15 percent" (the cuts he took when awarding tenders to multinational companies) or "The Total Man" (he owns Total Kenya). Daddy is also business partner of Naushad Merali, another Moi frontman, a multimillionaire and probably Kenya's richest Asian.

This would suggest our man Yaron mixes with the 20 and 30-somethings who are the children or spouses of Kenya's leading criminals. The senior members of this set are Biwott's Israeli wife Rita and his son in law Charles Field-Marshall, a controversial Kenya-based Canadian businessman.

Kenyan investors impressed with the investment climate in Rwanda

Kenyan investors have expressed confidence in the investment climate in Rwanda. A team from the Sameer Group of Companies expressed confidence in the country's leadership and investment climate, and said they were interested in investing in the tea, banking, construction and energy sectors.

Speaking after they paid a courtesy call on the President of the Republic of Rwanda, H.E. Paul Kagame, Mr. Joseph Schwartzman said, "We are have come from Kenya to look at investment in various sectors including tea, banking, construction and energy. We are very impressed with the leadership of this country, and have all the confidence and positive attitude which investors need. "

Also speaking after the meeting, the head of the Rwanda Investment Promotion Agency (RIPA) Mr. Bonaventure Niyibizi said, "Most people are impressed with the situation in Rwanda. They find that Rwanda provides an excellent investment climate. We have institutions and policies that have been created to help investors. These investors from Kenya are interested in various fields, specifically tea, banking, construction, and in establishing an export processing zone. Moi, Daniel arap (1924- ), second president of Kenya (1978-2002), who succeeded Kenyan independence leader and first president Jomo Kenyatta. Moi was born in a village in western Kenya, which was then a colony of the British Empire. He was trained as a teacher and taught from 1946 until 1955, when he was appointed to one of the African seats in Kenya’s Legislative Council. Moi won an elected seat on the council in 1957, and along with the seven other African elected council members he began pushing for an end to British colonial rule.

A member of the Kalenjin ethnic minority, Moi emerged as a leader and spokesman for the Kalenjin. In 1960 he helped found the Kenya African Democratic Union (KADU), a moderate political party supported by several minority ethnic groups. In Kenya’s 1963 pre-independence elections, KADU was defeated by the more radical Kenya African National Union (KANU), which drew support from the Kikuyu, Kenya’s largest ethnic group. Jomo Kenyatta, the leader of KANU and Kenya’s most popular independence leader, then became prime minister. After Kenya became independent in December 1963, KADU voluntarily dissolved itself and joined KANU. Kenya was established as a republic with Kenyatta as president in December 1964. Moi was made minister for home affairs, a clear sign that he enjoyed the favor of Kenyatta.

Moi allied himself with the president and moderates in KANU, and in January 1967 Kenyatta appointed Moi vice president. Moi served as vice president and minister for home affairs until Kenyatta’s death in 1978. During this period, Moi was extremely loyal to the president and faithfully executed the policies of the Kenyatta era. With Kenyatta’s support, Moi survived several attempts orchestrated by Kikuyu politicians to remove him from the office of vice president, which put him in line to succeed the aged Kenyatta. Upon Kenyatta’s death in August 1978, Moi became the second president of Kenya.

Moi ran unopposed in the presidential election of October 1978 and was confirmed in office. He began his presidency by adopting nyayo (Swahili for “footsteps”) as the watchword for his administration, signifying that he was following Kenyatta’s policies. He also cultivated a populist image by traveling throughout Kenya, addressing public meetings, and associating himself with popular policies, such as free milk for school children. Moi kept his opponents divided and disorganized as he appointed Kalenjin allies to important government positions and used the powers of the executive branch—greatly enhanced during his tenure—to solidify his rule. Moi’s presidency became increasingly personal and authoritarian as he began to use state power to consolidate his own political power and enhance his personal fortunes. In 1982 Moi made KANU Kenya’s only legal political party. In August the Kenyan air force attempted an unsuccessful coup to unseat him. Moi was reelected unopposed in 1983 and 1988.

The 1990s brought increasing demands for democratic reform from a wide spectrum of Kenyans, as well as from international aid donors. In December 1991 Moi agreed to legalize opposition political parties but encouraged political and ethnic divisions among the new parties. In presidential elections held in December 1992, Moi faced three major opponents who split the opposition vote. Moi was reelected president with only 36 percent of the vote. By 1997 Moi’s government faced popular calls for further political and electoral reform and an end to widespread government corruption. Moi repealed several repressive measures that had limited opposition-party activity. However, presidential elections held in December 1997 had results similar to those of the 1992 elections, with Moi winning 40 percent of the vote to defeat a fractured opposition.

Constitutionally prohibited from seeking another term, Moi handpicked the KANU presidential candidate in the December 2002 elections. Opposition parties united to sweep the elections, and four decades of KANU rule ended when Moi stepped down in late December. Moi published the book Kenya African Nationalism: Nyayo Philosophy and Principles in 1986, and in 1997 he published Which Way Africa?, a collection of speeches.

How Keiyo South MP honed political skills

Mr Nicholas Biwott was born at Chebor village in Keiyo District in 1941 in a devout Christian family.

His parents, Mr Biwott Cheserem and Ms Maria Soti, were among the first converts to Christianity in the larger Elgeyo-Marakwet District.

Ironically, the man who has had tussles with media, lately a string of record-breaking libel awards, had his first job in 1959 with the government Department of Information at Eldoret. He later teamed up with Mr Kendagor Bett to publish the Kalenjin Monthly newsletter.

Mr Biwott attended Tambach African Government School between 1950 and 1954. Among his teachers at Tambach was the man who would later be his boss of many years, Mr Daniel arap Moi. After Tambach, he joined Kapsabet Government African School leaving in 1958.

Among Biwott's school-mates at Tambach was Mr Daudi Tonje, a retired Chief of General Staff of the armed forces.

At Kapsabet, school-mates included Mr Njuguna Ndoro, a former Rift Valley provincial commissioner, and Mr Birech-Karuna, a retired senior Central Bank official.

It was while working in Eldoret that a local chief, Mr Willy Chirchir, helped renew acquittances between Biwott and old teacher Moi, who was now a big name in the national politics.

Mr Moi was impressed by the young man and helped him secure a scholarship in Australia. The chairman of the unregistered Saba Saba Asili party, Mr Kenneth Matiba, was working at the Ministry of Education and never tires recalling the role he played in processing the scholarship for the 19-year-old young man.

Mr Biwott graduated with a Bachelor of Arts degree in Economics from Australia between 1960 and 1965 where he met his future wife, Hannei.

He was initially employed as a District Officer in Meru, and was transferred to Nairobi where his resourcefulness, drive, efficiency and discreet demeanour saw him valued as an aide to a succession of senior public figures.

He rose through the ranks from assistant secretary to senior assistant secretary in the Ministry of Agriculture, under-secretary in the Treasury and finally under-secretary in the Ministry of Home Affairs.

At Agriculture, he served as personal assistant to the minister, Mr Bruce Mackenzie, where he honed his skills of operating in the corridors of power.

At the Treasury between 1969 and 1971, Mr Biwott worked under Mr Duncan Ndegwa, the first African governor of the Central Bank, who reportedly recommended him to Moi when he learnt that the then Vice-President and Minister for Home Affairs was scouting around for an efficient and trustworthy aide.

Mr Biwott first tried his hand at politics in 1974 when he tried to unseat Mr Stanley Kurgat in the then Keiyo South constituency.

He made little impression but by the next General Election, Mr Moi was already the President and it took little effort to persuade Mr Kurgat to stand down.

Mr Biwott has three wives. The first, Hannei, has two daughters-Rhoda Jeruto and Rita Cherotich. The two are married to Swede Per Jacobson and Canadian Charles Field-Marsham, respectively. Mr Field-Marsham is prominent in Nairobi business circles helping manage his father-in-law's vast commercial empire.

His second wife is a Tanzanian, Kavista Lessie, who has one daughter and leads a quiet life while the third wife, Dr Margaret Kamar, was nominated last year to the East African Legislative Assembly.

Dr Kamar is also principal of Chepkoilel campus of Moi University in Eldoret, and has been active in Maendeleo ya Wanawake politics in the Rift Valley.

Biwott had a role in Ouko death, court told By Nyakundi Nyamboga

Keiyo South MP Nicholas Biwott participated in the death of former minister Robert Ouko, a court was told yesterday.

Kabete MP Paul Muite, who has been sued for libel by Biwott, told the court through his lawyer that he would file an affidavit to show that Biwott played a role in the 1990 death.

"We stand by the statement. I will put out an affidavit to confirm that Biwott participated in Ouko’s death and there are several documents and evidence to prove this contention," Mr Daniel Maanzo said.

However, the court rejected a bid by Biwott’s lawyer Desterio Oyatsi to have the court record the pledge by Maanzo to file an affidavit.

" My lord, I request you to record the statement by Muite’s counsel. The allegation is grave and should be recorded," Oyatsi pleaded with the court for the third time.

Response

But vacation Judge P J Kamau was categorical in his response: "I will not record that statement. There is no such evidence before me. Besides, the lawyer is only holding brief for Muite’s lead counsel, Mr James Orengo, who is not in court today."

Biwott has sued Muite and Baraza Limited, the owners of KTN, over a news report he says defames him. The report was from an interview with Muite on the Ouko murder probe currently being undertaken by a parliamentary select committee.

Yesterday, the case was put off to January 21 after Muite’s lawyer requested for more time to file a replying affidavit.

Biwott’s lawyer had asked that the hearing of the libel suit begin immediately because Muite had been reported in the media last month as saying he was ready and willing to take on his client.

Muite then shot up to respond to Oyatsi’s plea.

" I did not say I would be ready to fight today. I made a general statement that I will fight a royal fight when I am ready," he said. But the judge reprimanded the MP for being out of order. (A litigant being represented by a lawyer in a case is not allowed to address the court.)

Oyatsi had also told the court that the hearing should proceed because a witness had travelled from London and was in court, ready to give evidence.

The witness, Mr Bill Waite, is to give evidence to show that two Italians, who claimed there was bad blood between Biwott and Ouko, were rogues and ought not be relied on.

Biwott’s lawyer also criticised Muite for not filing and serving him with his defence and replying affidavit in the libel suit.

The lawyer said it was illogical for Muite to ask for more time to file his defence and replying affidavit after stating in his grounds of objection to the suit that they were ready.

Muite’s grounds of objection to the libel suit were drawn on December 30 and filed in court the following day.

The legislator says the suit discloses no reasonable cause of action and an abuse of the court process.

The judge gave Muite and Baraza limited 10 days to file and serve Biwott with their replies to the libel suit.

Continuing a trend that began in 2000, high-ranking politicians and legislators—led by President Daniel arap Moi—brought several libel and defamation suits against the press last year. The judiciary responded by awarding record libel damages, introducing bankruptcy as a possible tool to silence critical media.

In July, President Moi and senior cabinet minister Nicholas Biwott filed a lawsuit against former U.S. ambassador to Kenya, Smith Hempstone, alleging that he had portrayed them as murderers in a 1997 memoir called The Rogue Ambassador. Kenya's largest and most influential independent newspaper, The Daily Nation, announced plans to serialize the book, but Biwott was granted an injunction on August 21 that forbade the paper from publishing any excerpts until the case was heard.

Moi and Biwott also sued a local bookstore chain, which was forced to remove the books from its shelves. A few days later, Moi's son also sued the Daily Nation for libel and successfully blocked the paper from publishing any stories about him until the libel case was heard. As of year's end, all these cases remained in court.

President Daniel arap Moi's choice of Uhuru Kenyatta as his preferred Kanu presidential nominee for the General Election due in December has attracted broad public interest, not least because little is known about Uhuru's personality.

Uhuru is said to have interests in Timsales Ltd, Kenya’s biggest timber dealer, Brookside Dairies Ltd, Prestige Hotels and Gicheha Farm in Nakuru, all businesses associated with the Kenyatta family. Uhuru is also chairman of ENK Management, an estate management company.

The Kenyatta family is one of the biggest land-owners in the country, possessing huge tracts of land in Kiambu district between Thika and Nairobi, the Rift Valley and Coast Provinces. They have thousands of acres under coffee, sisal and dairy pasture.

Members of the Kenyatta family are said to be close business partners with Naushad Merali, one of Kenya’s leading industrialists.

As chairman of Sameer Investments Ltd, Merali presides over an empire covering transport, agriculture, finance, construction, energy, information technology and mobile communications.

The Kenyatta family, together with a former director of the defunct Special Branch, James Kanyotu, and Merali, also have a controlling stake in Commercial Bank of Africa (CBA), Nairobi.

A freight company, Yana Air Cargo, set up in June 1991 with Uhuru as one of its directors, is said to be majority-owned by Merali, although it has since closed its operations at London's Gatwick Airport.

Incidentally, while Merali and the Kenyatta family are jointly associated with ventures such as CBA, in others – such as Firestone East Africa – Merali is associated with President Moi, suggesting there could be some business forces behind President Moi's choice of Uhuru.
