Ex-Intel veep, 'Mike' Hawash gets seven years in gaol
Price of conspiring to wage war on the United States

Palestinian-born Maher 'Mike' Hawash, 39 was accused of trying to enter Afghanistan to join Afghan Taliban forces attempting to repel the US-led invasion of that country.
His arrest prompted fellow employees to set up Free Mike Hawash Web site, after he was said to have spent four weeks in solitary confinment.
Hawash pleaded guilty to the charges against him, in return, it is reported, for a reduced sentence. Two co-defendants, Ahmed Bilal and 23-year-old Muhammed Bilal, were sentenced to 10 and eight years respectively. Two other men from Portland, Oregan, were earlier sentenced to 18 years in prison.
In better times, Hawash co-authored a book on using DirectX and other APIs.
Hawash was contrite before the judge in the Oregan courthouse. He said he was "proud" to be a US citizen and regretted his actions. "I do not blame anybody but myself," he said.
US District Judge Robert Jones, said Hawash's involvement in the affair had been a "mystery" to him. "I'm convinced," he told Hawash, "that you will never commit another criminal act." µ

Rule 5 was meant to put a stop to coercive police third degree practices, see United States v. McNabb, 318 U.S. at 344, and secret police interrogations. Upshaw v. United States, 335 U.S. 410, 412 (1948).
FOURTH AMENDMENT: The purpose for which a person is arrested does not alter the fact that a seizure subject to constitutional scrutiny has taken place. Cupp v. Murphy, 412 U.S. 291, 294, (1973); Davis v. Mississippi, 394 U.S. 721, 726-27, (1969); Terry v. Ohio, 392 U.S. 1, 10 (1968). The essential element is the physical restraint placed upon the person, not the purpose behind the restraint. Bacon v. United States, 449 F.2d 933, 942 (9th Cir. 1971). An arresting officer's determination of probable cause justifies;a brief period of detention to take the executive steps incident to arrest.; Gerstein v. Pugh, 420 U.S. 103 (1975). For continued detention a magistrate must make a prompt determination of probable cause. County of Riverside v. McLaughlin, 500 U.S. 44, 111 S.Ct. 1661, 114 L.Ed.2d 49 (1991).
Benjamin Franklin said that "They that can give up essential liberty to obtain a little temporary safety deserve neither liberty nor safety." And so it will be if our civil rights become collateral damage from the "War on Terrorism".
