I think they meant worse in regards to the prosecutions case. If the girl doesnt remember it happening she cant finger the guilty.

OTOH, they've apparently got lots of photos provided courtesy of the defendants. What more could a prosecutor ask for?

Unless they try to claim it was consensual, which would be somewhat unlikely to stand up if she is obviously comatose in the photos.
