The character 'Reddy Kilowatt' was devised in 1926 by Ashton B. Collins as a trademark to be used in the business of the Alabama Power Company with which he was then associated. Subsequently he severed his connection with the company and it took a license from him for the continued use of the mark. The present business of the plaintiff developed from these activities and the mark is now owned and used by the plaintiff corporation, which Collins controls.
