Teenager Walks Free after Admitting Male Rape

A teenager walked free from a Dublin court today after receiving a three-year suspended sentence for raping a 50-year-old man.

Gary Davis, now 17, from Rathmines, south Dublin had admitted sexually assaulting the man on November 12, 2001, when he was just 15, it was reported today.

He had been drinking with the victim and another man in a Dublin flat. As they left, in the early hours of the morning, Davis attacked the older man outside in a car park.

The victim called 999 but was too drunk to give details. He reported the rape the following morning and a subsequent medical examination confirmed he had been assaulted.

Davis was later found in possession of his victim’s gold chain by gardai.

In sentencing him at Dublin’s Central Criminal Court, Justice Paul Carney said he took into consideration Davis’ age and his guilty plea.

He added that Davis would benefit from continuing with the programmes he was currently on.

“He expressed remorse and was found to have been confused by his sexuality at the age the offence was perpetrated,” he said.

Justice Carney accepted Davis was now in a stable gay relationship and that his family had accepted his sexuality and were supportive.

He certified Davis as a sex offender and ordered that he remain under the supervision of the probation and welfare services.

If you read between the lines, it looks like the "victim" would have done the same thing to the boy if he wasn't so drunk.

An act committed as a juvenile... makes a big difference in the penalty. And possibly other circumstances... I kind of wonder if the "old guy" and the boy had been teasing around 'gaily' as they drank, before the rape. So they slap the kid on the wrist.

50 year-old guy with a gold chain is getting drunker than a hoot owl with a 15 year-old boy, in an apartment... He was a "victim" only in the sense that he was counting on pitching with the boy instead of catching.

What a trend this could set. Forget 'temporary insanity' and the required post-trial incarceration for a psych evaluation - just go with 'sexuality confusion.'

"I didn't mean to kill him, your Honor, but I was overcome by my feelings of confusion of my sexuality."

Could get that 5-15 reduced to 5 years probation and time served.
