If I were in Limbaugh's situation, I would definitely be interested in getting the prosecutor's agreement not to pursue the investigation further, in exchange for formally agreeing to do something I had already decided to do anyway. I would attempt to seek the prosecutor's agreement regardless of whether I was guilty of having actually committed a crime, or I was not.
There is a significant value in avoiding the need to have to defend yourself against a charge, avoid having to deal with attorneys, avoid the expense and publicity, etc. etc. This is true, whether you are guilty of having committed a crime or not.
At this point, Limbaugh is entitled to the presumption of innocence. He may or may not utimately be found guilty of having committed a crime. But Ray Black's letter hardly is evidence, one way or another, on that issue.
