The gentleman is guilty only of being a poor shot. Had he been a better shot, society could have been rid of one more "victim".

He needs to trade in the handgun for a shotgun. More cleanup involved, but a funeral is a lot cheaper than a lifetime of jail, plus medical bills for removing bullets!
