I attended a continuing legal education seminar last month, and one of the topics was "toxic tort" cases. This kind of case involved some poor plaintiff who contracted cancer or some other serious disease suing the nearest factory that discharged chemicals into the environment. The lawyer (from one of Alabama's biggest personal injury firms) admitted that usually there was not a conclusive link between the illness and the substance in question, or even that the defendant factory was even the source of the harmful substance (after all, the every other factory upstream might discharge the same thing). They would bring in their "expert", who might be the only person in the world who can diagnose that a certain substance caused the illness in question, to make the connection. Basically, they were suing because big bad defendant corporation MIGHT have discharged something that MIGHT have made poor helpless plaintiff sick, all based on junk science.
