This is probably one of the mildest spins the press will put on this. Dan Rather will probably say something like, "In a move which some critics say undermines Congress's constitutional oversight of the president's judicial nomination powers, President Bush today appointed conservative Judge Charles Pickering to the federal appeals court. The rare recess appointment came over the objections of minority and civil rights groups, who said that Pickering is insentitive to minority concerns and threatens fundamental civil liberties." And so on . .

FOX pointed out that Billyboy Clintoon also appointed recess judges--not the same level of judges that President Bush just did--I'm not sure what the hierarchy is--but he did do the same thing.
