Landmark Legal Foundation Seeks Documents from Palm Beach Prosecutor
[ 2004-01-15 ] HERNDON, Va., Jan. 15 /PRNewswire/ -- Landmark Legal Foundation today filed a freedom of information request with the Palm Beach County State Attorney's Office (SAO) seeking any and all information of communications to or from the SAO or any of its employees and outside individuals or groups relating to Rush Limbaugh. Mark R. Levin, President of Landmark, stated: "We want to know why Palm Beach County State Attorney Barry Krischer waited 10-months before investigating allegations against Rush Limbaugh -- only after stories appeared in the National Enquirer. We're concerned that once the story became public, Mr. Krischer, an elected prosecutor, may have been pressured to use extraordinary tactics and resources to punish Rush for his viewpoints." Levin added: "As the details of this investigation have appeared in the media, they've become increasingly troubling. False news stories claimed Rush was being investigated for money laundering and for a role in a drug ring, among other things. And now, Mr. Krischer is pursuing Rush on a 'doctor shopping' theory, for which he has no evidence, which is why he seeks access to Rush's confidential medical records. 'Doctor shopping' was not a priority of Mr. Kirscher's office prior to now. His office only brought such charges in one previous case, which was eventually dropped after the subject of the investigation died. Even elected prosecutors must, at all times, be above political influence. Mr. Kirscher's judgment raises serious questions about the impartiality of his investigation." Levin said further: "There also are numerous leaks coming from 'sources close to the probe' which are obviously intended to smear Rush. It is a felony in Florida to leak investigative information. Michael Edmondson, Mr. Krischer's spokesman, has been accused in open court and on television of being the source of some of these stories. Despite this 'journalist shopping,' Mr. Krischer has taken no steps to investigate and prevent these leaks. And Mr. Edmondson remains his trusted spokesman. Landmark will file suit against the SAO if it fails to produce the requested information." Sounds like a waste of time - why should a DA/SA have to respond to outsiders about an ongoing legal investigation? I'm not an attorney - but I think they are prohibited from doing so.

Could Edmonson "shopped" the original story to the enquirer?
Could the imunity deal with the Cline's contemplated their talking to Enquirer? Did the SA KNOW?!
Was the subsequent grass roots campain "organized"?
Remember, the butterfly protest campaing was organized with startling speed with the aid of a PR firm. Could that same PR firm be involved in orchestrating these protests?
I smell corruption indictments in the air.
(BTW FL just upped their penalties for official corruption.)

I'm not a lawyer either, but I would assume information, correspondence, etc. takes on a whole different character when it passes from the lawyer's control. For example, if the lawyer leaks info. to those outside of his office, such as to a newspaper, it becomes public information.

He is not requesting information about the investigation. The request is for information about the conduct of those involved in the investigation. That is always open to public scrutiny unless it reveals information which would compromise the investigation.

If a lawyer leaks information, he or she risks her license.
The FL bar once told an attorney if they broke attorney client confidence in a DUI investigation they risked suspension. The atorney knew the name of a DUI hit and run accident driver when the police did not. Ultimatly it became moot when the police figured it out.
An attorney is not allowed to blab in their capacity as an attorney. The only exception is to prevent a criminal act. (ie. Defendant says they are going to murder witnesses, pay off the judge, or something obvious.)
