And you're wrong about a trial -- Rush would take a plea, just like more than 95% of people facing charges, rather than go through a trial and risk jail time if found guilty. And Rush is not about to subject himself to the public scrutiny associated with trial.

I have never mention actual trial. A trial determination is only relevant when we know the actual charges. The prosecutor may have a terrible case. In those situations you are stuck. The prosecutor would rather loose a weak case to a jury verdict than suffer the negative PR of humanity.
It is one of the reasons drug court is paletable. There is no subjectivness in eligiblity. You are eligible or not.
As for scrutiny, that is what protective orders are for.
