This whole constitutuional issue is a sham.
The law gives the governor the right to overturn a convicted criminal's sentence, but Felos and the rest of the "right to kill" group say it is unconsitutional to save Terri's life, because Michael, the husband in name only, wants to kill her.

We cannot starve a prisoner on death row because they would claim that it is cruel and inhumane. People cannot starve their farm animals or pets because it is cruel and inhumane... after all, animals are innocents and they depend on us for food and care... so why is is ok to kill a innocent human being that cannot speak for herself or care for herself? MS's actions are reprehensible, He sues for malpractice and the money was awarded for her care and rehabilitation and then he spends the bulk of the money on trying to have her killed by starvation.

My question exactly. And in the meantime she is denied the treatment and rehabilitation any severely disabled individual deserves and by law should receive.
It's mind boggling.

They have all failed. The higher courts won't go against one of their own. Law enforcement won't investigate. Florida DCF won't investigate. State Attorney Bernie McCabe won't investigate. The Guardianship Committee won't investigate.
There is ample reason to start an investigation by any one of these authorities, yet nothing happens.
I truly don't know how the Schindlers bear it.

One must also keep firmly in mind, with respect to the law being challenged, that the state could well pass a clearly constitutional law which has a more powerful effect in curtailing a purported right; namely, a total ban (no gubernatorial discretion) upon slow starvation and thirst deaths sans a written directive. Such a law would be no more unconstitutional to apply to Terri, than if the state had issued Michael Schiavo a CCW permit, then rescinded all CCW permits by law 6 months later while the original CCW permit was under litigation for some reason. If a more powerful law would be constitutional, then a forteriori a less powerful one would be.
Courts are not gods standing on Mt. Olympus. They are hired by the state to decide questions of laws which can change, not to fix legal rights in stone, although they, and shyster philadelphia lawyers, often do pride themselves to imagine the latter.
