DELHI - A 28-year-old San Jose man was shot and killed by a sheriff’s deputy here early New Year’s Day after reportedly firing a rifle in the direction of the officer.

At 12:11 a.m., Lamberto Herrera was pronounced dead after being shot at least twice by the deputy. He was in the backyard of a home in the 9000 block of Phelan Street.

Inside the home, a small gathering of family and neighbors was celebrating the new year while the shooting occurred outside. Herrera was not a guest at the home where he was shot, according to the sheriff’s department. He was in town visiting a nearby neighbor.

Undersheriff Bill Blake said Thursday that the shooting appears to be clearly justified. However, some family members of Herrera said they didn’t believe it was necessary.

Tonight, on the local news in Fresno, Herrara's sister was interviewed, throught an interpreter, since neither she nor Herrara speak(spoke) English.

Her tearful, eye witness type presentation and would have been more believable were it not for the fact that she wasn't even present during the shooting. That didn't bother the local media however who presented a sympathetic story never mentioning both Herrara and his sister are illegal aliens, that Herrara fired 41 shots from his rifle while tresspassing in the neighbor's yard before he was confronted by the officer and that it appeared Herrara was either highly intoxicated or under the influence of a controlled substances at the time of his shooting spree. (The information regarding the 41 shots and Herrara's condition at the time of death are drawn from other news reports emerging today)

If you wonder why California is having problems dealing with the consequences of illegal immigration you can thank the press for their participation in this and similar farces. Hopefully the family will not file and win a civil suit against the Merced County Sheriff's Office.
