I have never heard of such a privacy right in regards to medical records. Based on what?

Property rights. Individual liberty. A better question is, when we gave the Gubmint the right to intrude into every aspect of our personal life, and have immediate access to any shred of personal data?

The Federal government, especially the Federal judiciary have chosen to totally ignore the 9th and 10th amendments. The USSC misuses the 14th to ignore the 2nd, 9th and 10th.

The USSC cares not what the Constitution says unless they can make it say what they want it to say.
