The dhow intercepted by the USS Decatur moves under its own power in the Arabian Gulf. A U.S. Navy boarding team operating from the guided missile destroyer USS Decatur (DDG 73) discovered an estimated two tons of narcotics with a street value of around eight to ten million dollars aboard a 40-foot dhow intercepted in the Arabian Gulf. The dhow's 12 crewmembers were taken into custody and transferred to USS Decatur, and Decatur sailors are in control of the dhow. DoD photo by Petty Officer 2nd Class Michael Sandberg, U.S. Navy. Boats that look like the above.
When they carry drugs and get hooked on it, it's called a "dhow jones." (ouch)

Question: Is this in international waters? If so, under what jurisdiction do we intercept? Besides it being morally right, of course. What legal precept are we employing?

Legal precept: War.
There's also an outside chance that one could interpret Congress letter of authorization as a "letter of marque." Just mho.

You're killin' me, man! :-)

From the
Navy.mil web site's story:
"Decatur was operating near the Strait of Hormuz, conducting Expanded Maritime Interception Operations designed to deny use of the seas by terrorists and smugglers."

When I was in bootcamp, I was told that the US Navy existed to keep the skies free and the sea lanes open. Generally speaking, as in days of old, the US Navy has always fought piracy on the seas and intercepted rogues who would deny free trade among the nations.
The Fifth Fleet rules the Middle East hotspots.
