the Dem Senate would never have voted for it after 9/11, and with a one seat majority and people like Specter and Snowe et al, we could mever win that vote.

I disagree. Had GWB asked for it, he would have gotten it.

And I believe he could still make the case before America today (citing this particular incident as one reason among many), and that he'd get it.

The first pseudo-declaration was foolish, and evolved from a smoke-filled room. It grants nothing under color of law.
