Perhaps but this decision didn't make any attempt to address them and they had an opportunity to do so.

Appellate courts do not appoint lawyers. They order lower courts to do so. :) Lower courts have a lot of interesting folks as judges. Count on the lawyers to raise hell. It is in our blood.
