Rumsfeld repeatedly pointed out that if he were found to be involved in the insurrgency, it would change his status. That has a direct effect on his rights and regarding questioning, which will go on and on for a LONG time before he is turned over to any tribunal.

If he's directing a non-regular force, without recognizable uniforms, command structure, etc., doesn't that just make him another terrorist? POW status would imply too much stature for him...

Rummy said last night in an interview that if he is involved in the insurgency, that could nullify his POW status.

Being out of uniform directing sabotage and other "unconventional" warfare normally warrants a blindfold, a cigarette, and a nice pole to lean against. They were showing members of the Nazi "Werewolf" movement being shot by US firing squads in '45 on the History Channel a few nights ago.
