SACRAMENTO (AP) - In a defeat for business groups, a Sacramento County judge blocked a March voter referendum on a law requiring that hundreds of California employers help provide their workers with health insurance.

Superior Court Judge Lloyd Connelly ruled that petitions used by business groups opposed to the law lacked adequate notice of what the referendum would do.

What's the big deal... The Supreme Court just ruled that the First Amendment doesn't really mean anything...

You can't have political advertising before an election... Now, you can't petition to have a grievance resolved... No big deal.

..the summary of the law prepared by the attorney general's office was misleading because it failed to disclose that the statute wouldn't require small employers to provide health coverage unless the Legislature passed a subsequent tax break for those business owners.

The law's chief authors, Democratic Sens. John Burton of San Francisco and Jackie Speier of Daly City, filed a lawsuit challenging the petition campaign.

Their challenge said the petitions also failed to meet a requirement to have a short title "showing the nature of the petition and the subject to which it relates" on each page. Only one of the eight-page petitions included that disclosure.

Burton and Speier also said the attorney general's summary was misleading because it contended that health insurance mandate would affect employers with as few as 20 workers. They said the summary failed to disclose that employers with 20-49 employees wouldn't be affected unless lawmakers and the governor approved the tax break for small employers.

Robin Johansen, an attorney for the two lawmakers, said there was no guarantee the Legislature would pass the tax credit and that it was even less likely that new Republican Gov. Arnold Schwarzenegger would sign it.

S. Craig Hunter, an attorney representing the referendum's supporters, acknowledged there were technical flaws in the petitions but contended they substantially complied with the law.

Hunter said the required disclosure on one of the eight pages was adequate because the document opened up like a road map with half of the eight pages on the front and the other half on the back.
