A Constitutionalist should understand when they're going overboard with the "felony" crap. Clinton committed numerous felonies, but "felonies" are subjective.
When the "legal system" starts talking about "felonies", I become extremely sceptical.
By definition, each spam run steals thousands of dollars (even if you forget about the damage to network functionality and only count the time taken to "just hit delete" and chalk it up at minimum wage). Stealing thousands of dollars is a felony in every jurisdiction with which I am familiar.
