To: FirstPrinciple
When bad legislation keeps coming up as an issue (and some are certain that it is unconstitutional), passing the legislation is needed to get it stricken down on as unconstitutional (takes it off the table).

And what happens when the Supreme Court thinks that the legislation is just peachy? Is it all of a sudden Constitutional then? And why can't the legislators refuse to vote for something that is unconstitutional? The Legislature is a co-equal branch of the govt and has as much right to interpret the Constitution as the other two branches. Why can't the President veto the legislation for the same reason as the Legislature? I think what you are saying is that the President and the legislators have to stand for re-election and may not have the courage to veto such laws. Well, in that case, they should step aside and let people with backbone govern.
