Some, like Wal-Mart and Target, already collect sales taxes for online purchases in the 20 interstate tax program states, according to Duncan.

The writer didn't follwup by reporting that WalMart and Target have a physical presence in those states, which is the actual basis for collecting a state sales tax.

This law is a radical departure from the physical presence test.

that's right, that part of the law is legitimate.

remember, this law will also apply to all catalog companies to, its not just "online" merchants.

An additional radical departure is that collection would not be based on the residence of the seller but of the buyer.

Online sellers based in no sales tax Oregon would still be required to collect and remit taxes to other states if they sell to residence of the the state.

And while there will be a round of legal wrangling before SCOTUS if this passes, I have no faith in that body's commitment to constitutional jurisprudence.
