You could be right but isn't it somewhat risky to lock yourself into a story when you're not sure? In the Michael Peterson case the prosecution advanced the theory that he killed her with a missing fireplace poker. Late in the trial the defense was able to produce it and show that it hadn't been used. They did get a conviction but most of the legal experts agreed that it was a major problem for the prosecution.

Well, I don't think the prosecution has locked itself into the story. I think that's just what reporters are reporting. Who knows what the prosecution really thinks?
As for Michael Peterson, yes, that was quite a moment. Didn't they say that supposedly there were numerous pokers or "blow-pokes" like that one, around that large house?
I always thought there was something fishy about the sudden production of that poker, "covered with dust and cobwebs".
