November 20, 2003 -- Six former Kmart executives allegedly misspent more than $1 billion - some on personal luxuries like fancy cars and private drivers - even as the company teetered on the brink of bankruptcy, according to a lawsuit brought by creditors. The civil suit filed Tuesday in Pontiac, Mich., by the Kmart Creditor Trust accuses CEO Charles Conaway, CFO John McDonald and four other executives of breach of contract, breach of fiduciary trust and unjust enrichment.
