November 19, 2003 -- MODESTO, Calif. - Scott Peterson was ordered yesterday to stand trial in the murder of wife Laci and their unborn son after investigators testified he and his mistress, Amber Frey, called each other 241 times over a 93-day period that began a year ago today.

Modesto Detective Jon Buehler recalled one conversation, secretly recorded on Jan. 6, in which Frey threatened to tell cops about the affair and some things Scott told her during their private talks.

Peterson, in the same call, urged her to continue dating him.

Lawyers introduced a transcript of the conversation into evidence but did not play a tape.

"Sweetie, you think I had something to do with her disappearance? Amber, do you believe that?" Peterson asked, according to the transcript.

Frey: "Well, let's see how can I believe? How can I believe that? How could I believe anything for . . . ?"

Peterson: "I am not . . . evil like that."

Frey: "I would hope not."

Peterson told Frey he was "longing to hold on to" her, Buehler testified, adding that he was with Frey during the conversation.

The 12th and final day of the preliminary hearing began with testimony from a prosecution phone sleuth who logged each of the 241 calls on a large calendar with pink ink for Amber's calls and blue for Scott's.

The most calls in one day was on Dec. 26 - two days after Laci Peterson's disappearance - when Scott called Amber twice and she called him 14 times, Steve Jacobson testified.

But Peterson's lawyer, Mark Geragos noted, there were no calls on Valentine's Day.

Buehler, the detective who worked closest with Frey, said she recalled for him an incident two weeks before Laci's Christmas Eve disappearance when Peterson came to her house and told her he'd lost his wife.

Peterson was "showing emotion and saying he'd lied to her, that he'd been married in the past and he'd lost [his wife] and this was going to be his first holiday without her.

Talk about cold ... "the girl I'm married to". It reminds me of the note he posted at the volunteer center ... signed, "Laci's husband". He certainly struggles with the term "wife"!

Notice he didn't say she disappeared Christmas Eve but just before Christmas. ... rather telling.

The prosecution seems to have a very weak case. Everything they presented so far is what would be found for any husband having an affair.

The prosecution has a very good case against him proving that they lived together, and that he cheated on his wife, but nothing to prove he actually killed her.

NARAL to Pay Half of Scott Peterson's Legal Fees
(2003-11-19) -- The National Abortion Rights Action League (NARAL) today announced it would pay half of the legal fees for the defense of Scott Peterson, who is accused of killing his wife and unborn son. Mr. Peterson was bound over for trial in California yesterday after an 11-day preliminary hearing.

"We don't know whether Mr. Peterson is guilty of killing his wife," said NARAL President Kate Michelman. "But no matter what he did to the fetus, it's okay because the fetus is not a human. It's an outrage that the court is putting Scott Peterson on trial for something that America's fine abortion doctors do legally hundreds of times every day."

It appears that SP has entered a new phase in his road to hell. Evidently his right to a speedy trial does exist from this point on. The judge having found that, "offenses in the within complaint have been committed, there is sufficient cause to believe the within named Scott Lee Peterson is guilty thereof." , has set the formal arrignment for December 3rd. He also gives SP the option to "waive time" and postpone the arraignment a coiple of days.


14 THE COURT: It's a little more than that.
15 The Court has considered all of the evidence, and it
16 appearing to me that the offenses in the within complaint
17 have been committed, there is sufficient cause to believe
18 the within named Scott Lee Peterson is guilty thereof. I
19 order him to be held to answer to the same.
20 Specifically, I find that there is sufficient evidence
21 for the two counts of murder, that they were committed
22 intentionally, deliberately and with premeditation, further,
23 that as to Count One, the killing resulted in the
24 termination of Laci Peterson's pregnancy, and, also, that,
25 finally, there is sufficient evidence of this special
26 allegation pursuant to Penal Code Section 190.2(a)(3)
27 involving more than one murder.
28 Arraignment will be in 15 days from today. I think

2 Friday? December 3rd is a Wednesday.
3 MR. GERAGOS: Is -- could we do the pre -- is that a
4 holiday, the previous Friday?
5 THE COURT: Yes. I believe it's Friday --
6 MR. DISTASO: That's Thanksgiving.
7 MR. GERAGOS: Right. Could we do the day after -- the
8 first day back, the 1st?
9 MR. DISTASO: That's fine with me if that's fine with
10 the Court.
11 THE COURT: The only trouble is that the courthouse is
12 rather crowded on that Monday with the jury trials starting
13 that day. So we can leave it on the 3rd, or if you want to
14 waive time, we can go to that Friday, if you want --
15 MR. GERAGOS: No, the 3rd is okay. That's fine.

So now we know when the right to a speedy trial begins.

I have wondered how people can be in jail for years on end without ever being found guilty of a crime.
