A federal judge in Baltimore ruled yesterday that a $10 million excessive-force claim can go forward against an FBI agent who shot an unarmed Pasadena man in the face after mistaking him for a bank robber.
It was a key hurdle in the closely watched case involving Special Agent Christopher R. Braga, who shot Joseph C. Schultz with an M-4 rifle during a botched arrest March 1 last year.

Yep. I seem to recall that this isn't the first time Barga was involved in a 'questionable' shooting. But I could be wrong about that.
Nonetheless, the SOB should have been prosecuted to the fullest extent of the law.
First, none know the true facts. Second, IF Shultz' hands went below the door line, there may have been a reason to have fired; or the Agent would have nbeen fired. The most important rule in LE is to go home at night; the agent did - the rest will be solved in time. If you do not like ATF, but love armour piercing bullets, machine guns, cannons and grenades, if you hate DEA because you want your drugs etc etc, it is your idiotic prattle that, if taken seriously by most Americans, would result in anarchy.
Wait for the facts, and if you do not like the Law, write your representatives and vote.
Anyone who lives by that rule alone is in the wrong business. That's the "shoot first and ask questions later" rule. The use of deadly force is not an issue to be taken lightly.
Yeah, except that the agent ORDERED the guy to open his car door, then shot him when his hands went to the door handle. The guy was doing everything he was ordered to do, and he still got shot in the face for it.

The JBT didn't contend it was an accident. He didn't express any regret.
Rather, he stated that he should be immune from civil action because he is a federal agent, and (in his mind) above the law.
And you think that anyone who disagrees with that is a "law enforcement" hater (note I didn't capitalize those words as you do, because I don't worship them.)?

The reason his hands went below the door line was because other JBTs were yelling "get out of the f*****g car" with their guns pointed at him. Schultz was wearing his seatbelt, like a good citizen, so he went to unbuckle it.

I thought the most important rule was to "protect and serve". But I guess I'm thinking of a different America.
But I guess it's okay for federal agents to shoot innocent kids as long as "they go home at night".

Gee, America got by for 150 years without the ATF or DEA, or any laws governing alcohol, tobacco, or firearms. Would describe the first 150 years of the Republic as "anarchy".

My problem isn't so much with the law, rather the fact that there is one set of laws for us peasants and another for our rulers and their 'enforcer' class.
I remember reading something to that effect.
