Judge lets suit against FBI agent proceed
Baltimore Sun ^ | November 14, 2003 | Allison Klein

A federal judge in Baltimore ruled yesterday that a $10 million excessive-force claim can go forward against an FBI agent who shot an unarmed Pasadena man in the face after mistaking him for a bank robber.

It was a key hurdle in the closely watched case involving Special Agent Christopher R. Braga, who shot Joseph C. Schultz with an M-4 rifle during a botched arrest March 1 last year.

Braga, in requesting dismissal of the suit, contended that he had immunity because he is a federal agent.

Not surprising after Waco and Rudy Ridge, but disgusting nonetheless.

The FBI, DEA, and especially the ATF are all a menace to society. Get rid of em.

FBI Agents who make poor decisions should be FIRED, PROSECUTED, and if found guilty, IMPRISONED.

Anyone who is equipped with a badge and gun had better know that they will pay a steep price if they make harm an INNOCENT CITIZEN.

Immunity because he is a "federal agent." That's pretty damned scary as far as I am concerned. I remember being outraged when this fiasco happened and am glad to see the young man getting his day in court. Hopefully there is a financial settlement in his - and the girl's - favor.

No surprise from Braga. He got away from the criminal charges. He now thinks he can get off from all responsibility from his violation of SOP.

Probably.

But don't worry. Once we get a Republican in the White House, he'll clean up the corruption at the DOJ. /sarcasm

Yep. I seem to recall that this isn't the first time Barga was involved in a 'questionable' shooting. But I could be wrong about that.

Nonetheless, the SOB should have been prosecuted to the fullest extent of the law.

Perhaps Braga might find it useful to phone up OJ for advice and consolation....

Personally, I have no use for the investigative abilities of the FBI. Nor do they have credability when it comes to solving a case, or more likely, having a case solved for them, and taking credit. However, I find the positions of Law Enforcement haters in this thread totally absurd and unwarranted.

First, none know the true facts. Second, IF Shultz' hands went below the door line, there may have been a reason to have fired; or the Agent would have nbeen fired. The most important rule in LE is to go home at night; the agent did - the rest will be solved in time. If you do not like ATF, but love armour piercing bullets, machine guns, cannons and grenades, if you hate DEA because you want your drugs etc etc, it is your idiotic prattle that, if taken seriously by most Americans, would result in anarchy.

Wait for the facts, and if you do not like the Law, write your representatives and vote.

Wasn't Braga involved in another shooting prior to shooting this kid?

Anyone who lives by that rule alone is in the wrong business. That's the "shoot first and ask questions later" rule. The use of deadly force is not an issue to be taken lightly.

Yeah, except that the agent ORDERED the guy to open his car door, then shot him when his hands went to the door handle. The guy was doing everything he was ordered to do, and he still got shot in the face for it.

or the Agent would have nbeen fired

Hah.

Read the article.

The JBT didn't contend it was an accident. He didn't express any regret.

Rather, he stated that he should be immune from civil action because he is a federal agent, and (in his mind) above the law.

And you think that anyone who disagrees with that is a "law enforcement" hater (note I didn't capitalize those words as you do, because I don't worship them.)?

First, none know the true facts

B.S. The kid who was assaulted, and his girlfriend who was terrorized know the facts.

Second, IF Shultz' hands went below the door line, there may have been a reason to have fired; or the Agent would have nbeen fired

The reason his hands went below the door line was because other JBTs were yelling "get out of the f*****g car" with their guns pointed at him. Schultz was wearing his seatbelt, like a good citizen, so he went to unbuckle it.

The most important rule in LE is to go home at night; the agent did - the rest will be solved in time.

I thought the most important rule was to "protect and serve". But I guess I'm thinking of a different America.

But I guess it's okay for federal agents to shoot innocent kids as long as "they go home at night".

If you do not like ATF, but love armour piercing bullets, machine guns, cannons and grenades, if you hate DEA because you want your drugs etc etc, it is your idiotic prattle that, if taken seriously by most Americans, would result in anarchy.

Gee, America got by for 150 years without the ATF or DEA, or any laws governing alcohol, tobacco, or firearms. Would describe the first 150 years of the Republic as "anarchy".

Wait for the facts, and if you do not like the Law, write your representatives and vote.

My problem isn't so much with the law, rather the fact that there is one set of laws for us peasants and another for our rulers and their 'enforcer' class.

I remember reading something to that effect.

But, hey, as long as the SOB goes home at night, what's the big deal?
