Judge Greer's pivotal "finding of fact" in the Schiavo case determining a life-or-death issue is based on something Terri allegedly said after watching a TV show. Michael didn't know his wife was bulimic, but he distinctly remembered Terri's remarks about a TV show. (It was an episode of "Melrose Place," during which she said that Heather Locklear's shoes were "to die for.")

Was Terri's alleged statement made after a TV show? Or was it made as she was leaving Michael's grandmother's wake?

Or how about the comment she made to her girlfriend regarding Karen Ann Quinlan? "Where there's life, there's hope."

In the absence of a formal written statement by Terri, who is the most credible witness? What are the motivations of each? If Terri's gf's statement is considered to be hearsay, so should Michael's, and those of his siblings. If the same weight is applied to both sides, there is a moral and legal obligation to "err on the side of life," which supercedes Michael's authority of guardianship. The State has the obligation to protect and defend innocent life.
