Ill bet they believe that there are people, strangers who, if you shake hands with them, can and will make their penis (should they possess one) disappear. It was in the news so it must be true.

The real problem here is the way the prosecutors handled the case. Because they did not charge Durst with abuse of a corpse or any number of other charges along with the murder charge, the jury had not choice but to disregard the dismemberment.

The reason the missing head was used by the juror is that without the head, bullet trajectory, etc could not be determined. That meant that the self-defense claim had more validity.

Further, the defense used the fact that Durst is so ODD, (ok, nuts) to bolster his claim that because he is so strange, he was afraid no one would believe him if he claimed self defense.

Bottom line, overly confident prosecution and well paid defense attorneys did this.

I am just as outraged about it as anyone, but being a Texas resident, I am exposed more to this story and the laws of this state.

Dust mites aren't funny. They are very serious and concerned about unnecessary convictions of accidental serial killers. And where are all these headless people coming from? Is this some Vast Headless Person Conspiracy to set up accidental serial killers for needless convictions?

Something must be done. It's for the chillren.

I would like to see a profile of the make-up of this pathetic jury. I really think that people are becoming too morally corrupt to make the jury system work in this country. With no common sense and no sense of right and wrong, we will have to go to trained professional jurors who may have a clue when it comes to dealing with these slimy defense attorneys. Too bad they don't have to become personally liable for the future actions of the criminals they get off.

But, widely reported here, like the killer monkey in India. I do believe the scary strangers were in Africa.

One can reasonably fathom that the state was faced with prosecuting such a heinous crime committed by an admitted murderer and a known criminal and figured Durst was palpably guilty and therefore they neglected to include charges that were certainly relevant to the commission of the crime. In hindsight, they surely wish thay had been more diligent in the prosecution of the crime.

However, the judge could have compensated for some of these discrepancies in her charges to the jury before deliberations by telling them the scope of their responsibilities vis a vis the evidence.

The jury itself has no excuse, they should have added the facts properly and disregarded the fairy tales concocted by the defense. If you have committed a crime of self-defense, you call the police immediately. You don't dismember the body and toss it away like so much garbage nor do you put the head in a bag and try to board a plane with it in your possession, as Durst did.

Even a hung jury would have been better than a not guilty verdict.

I don't disagree with either of you. The prosecution did exactly as you said, Liz. They thought that given the horrible details of this and his history, that it would be a slam dunk conviction.

As far as the jurors go, kitty, they are not exactly the brightest and best of Texas.

It is a real tragedy that Mr. Black did not get justice. His family is filing a wrongful death suit at least. That will be easier to win. Just like OJ

I hear the Dumbocrats are going to organize a 2004 convention caucus on this issue.....another special interest hyphenate: American-Accidental-Serial-Killers-Caucus. Only delegates from Galveston are eligible to caucus.

The prosecution made a huge mistake when they took lessor charges (including manslaughter) off of the table. They, evidently, couldn't [b]prove[/b] intentional murder 1. The burden on the state to prove murder 1 is much higher than manslaughter.

Not sure what decision I would have made on this jury, but I find it interesting that so many folks on FR want to land on the side of the state in this one, when we do not know that the state made it's case. We see a dead man, a dismembered corpse, and the man who caused the dead man's death, and we go, presto, bingo, murder 1, hang him.

The prosectution couldn't prove intent, couldn't show anything other than Durst caused the death, which is not murder 1. The dismemeberment of the dead guy has no bearing of guilt on a murder 1 charge.

They took lessor charges off the table, and now we all have to pay the price. Their fault, not the jury's.

My 2 cents.
