Don't you believe that the 7th Amendment applies to states? SCOTUS does. CAPITAL TRACTION CO. v. HOF, 174 U.S. 1 (1899)

Wrong again Diogenes but hang in there.

Wrong again?! You mean I've been wrong before?

OK, I was wrong about the 7th Amendment applying to state courts. You were right. You are the 7th Amendment expert here. I bow to your superior knowledge of the constitutional requirement for civil juries in common law cases in state courts not handling federal rights cases.

(But you're still wrong about the 1st Amendment.)

Ah this discussion reminds me of the good old days in law school when the civil procedure professor fixated on the difference between substance versus procedure. I am still not sure what the difference is, but your 7th amendment incorporation discussion reminds me of it, and my salad days.
