I'm sure both his staff and the Air Force know what they're doing.

Besides, if there was any conflict (and I don't think there would be), but if there was, it would be in his capacity as a judge, not as a senator. I fail to see why a military judge for the Air Force can't vote on the appointment of federal judges, though.

The Federal Circuit Courts oversee the Military Courts of Appeals. I don't think there is any problem, but I am just a little gun shy with the current crop of libDems and anything remotely judicial, especially in the Senate.
