I don't think it was that they had guardianship, but that when time came that a guardian had to be appointed, they agreed to allow Michael to be the guardian. Apparently they could not have conceived of how he would abuse that role.

I hate to say this, but by Florida law - the statutes written by the legislature - Judge Greer's ruling was legal.

Well, sort of. Maybe.

As an analogy, suppose someone stands accused of committing a robbery/murder in one location at the same time as they were singing the Star Spangled Banner at the opening of a widely televised sporting event. The only evidence against this person is the a surveillance tape which shows someone of the defendant's height and build but does not show the person's face or other distinguishing marks.

Would it be legal for the judge to convict and sentence the person for the robbery?

If that doctor failed to provide basic standards of care for Terri, stood by and did nothing while Michael demanded her physical needs be neglected, he can lose his license. Maybe he should be reported to the state medical board.

Then of course, he could face lesser penalties in exchange for testimony against Felos, Schiavo and company. :-)

He might be the weak link.

Heavenly Father, we return to give You thanks that You have, this day, led in so many directions on behalf of this mother's child. We pray that You would take each effort and bring them together, and under the Power of the Holy Spirit, send them forth in the areas of Your choosing, that this will eventually lead to Terri escaping the bonds of confinement and returning to the freedom of her family.

We continue to beseech You, dear Lord, for her safety ... especially in those times when she is visited by those who wish her death. We are so fearful, but You would have us rest in Your promise:

Be anxious for nothing, but in everything, by prayer and supplication, with thanksgiving, let your requests be made known unto God... and the peace of God, which passes all understanding, will keep your hearts and minds in Christ Jesus." Philippians 4:6-7

Father, the wrath of evil is falling upon this dear child. May the angelic host encamp around her bed .. may there be a shield above her head .. let nothing come near her that would bring harm. Pour out Your spirit of compassion upon her caregivers, that they might recognize that this is a woman who has been touched by the hand of God .. may they show Your love as they tend her. May the Doctor who treated her in the hospital be upheld in prayer, for he is the only one to come to her aid. Protect him from criticism and harm, for noble was his action in the face of threat. We pray that Terri's hospice physician will be a man of faith ... if his heart has not yet been quickened, I pray that You would do so, dear Lord. Terri is in need of loving hands to touch her and words of comfort to cheer her .. provide for her these things, Father, in the absence of her dear family.

We continue to pray that those who wish her harm would repent. Give to them such a restlessness and a sense of shame ... may they be looked upon with scorn ... may they claim the redeeming blood of Jesus Christ, that they not be found guilty.

Father God, Terri is in Your care ... help us in our desires to be instruments that lead to vindication of her parents' love ~ give her rest this night and joy in the morning. Thank You for setting before us this young woman, disabled in body but not in spirit, that we might be called to protect the least of these, my brethren. In the Name of Jesus, I pray, Amen ...

If you desire to declare an adult incapacitated and in need of a guardian the court requires an attorney be appointed to represent the alleged incapacitated.

The duty of the attorney is then to go to the person and interview them if possible. There must also investigate to find additional relatives and any inditia of assets. Often this has to be done very quickly. Sometimes there is less than 24 hours. At the hearing the attorney delivers a report ot the judge (or magistrate in larger counties). Once the person is (or is not) found incapacitated the attorney is discharges from the case.

In this case, the issue of incapacity would not really be in question.

Didn't Pat Anderson try to file a divorce petition, and it was thrown immediately out of the corrupt FL courts?

Parents have no standing to file divorce proceedings on behalf of their children. A guardian ad litem would have standing--part of why Judge Greer had to flout the law that is supposed to require them in cases such as this.

Her husband never claimed she had "no brain function".
A persistent vegetative state is not brain death.
There is function in the more primitive areas, allowing cycles of sleep and wakefulness, object tracking, etc.

Also people in a persistent vegetative state are not in comas. No one claimed she was in a coma.

"His" claim, supported by expert medical opinion and testimony, is that she is in a persistent vegetative state.

Keep your opposition to THIS diagnosis. Any other is a false claim and a straw argument.

I think there are several weak links, we just have to find their point of weakness. That will take tenacity on our part. Perhaps we should organize ourselves into groups that will focus on specific players in this case and see where it leads.

Well, I guess it couldn't hurt. I'd be willing to bet, though, that Larry King is only going to ask questions that will help Schiavo spin his web of deceit about Terri.
