Why would anyone take the word of Terri's sleazy husband?
What's next? Scott Peterson's defense maintaining that Laci wanted to die and he was just following her wises? You think that is abusurd? Well, so is letting Terri die on the bases of the words of a person lacking any credibility.
Given the things he has done and said and the timeline of those events it's amazing he hasn't been investigated for attempted murder. It's beyond amazing that he is recognized as her legal guardian. I posted a synopsis of his actions and vested interests in her death here.
