Where does a judge get the nerve to determine that Terri ought to be put to death...what has happened to the protection found in having a jury make that determination?

Well their starting out with the most helpless this time- the unborn, the elderly, the disabled like Terri unable to speak for herself - the easy ones. Of course it's all for "compassionate" reasons.

Apparently the FL populace is as ignorant about the FL Constitution as they seemed to be in some counties about "butterfly" ballots.

It is obvious to me, that Schiavo is enjoying his power over her parents.
Reguardless what the husband wants in all this, the wishes of the family should be paramount in the final decision of this poor womans life.
There is something seemingly sinister about the husbands, and the courts postion in this matter.

Governor Bush could stop this if he wanted to. He just doesn't want to get involved.

Without breaking the Constitution he cannot get involved. He has said so himself. Do a little looking before posting such crap. The problem is that there are so many of you that think this way. Do you want the Constitution to be in effect or just toss it?

Then why are these other lawyers sending info saying just the opposite!!!! That is where we are all confused. DO THEY NOT KNOW THE LAW TOO??? Sean Hannity said the other day that Thompson law firm is one of the finest. Just doesn't make sense to me.You would think that THEY KNOW TOO. The LAW PROTECTING the disabled is being BROKEN...he has the responsibility to see that the LAWS of the STATE are carried out. THIS LAW IS NOT BEING CARRIED OUT!!!!!!

There is a depravation of constitutional guarantees taking place, and a judge who has acted as judge and jury in determining the truthfulness of Terri’s husbands assertions. Since there is no will, in this particular case, with both sides saying something different, a jury ought to determine who is telling the truth, as provided in Florida’s Constitution!

That Constitution states:

SECTION 2. Basic rights.--All natural persons, female and male alike, are equal before the law and have inalienable rights, among which are the right to enjoy and defend life and liberty, to pursue happiness, to be rewarded for industry, and to acquire, possess and protect property; except that the ownership, inheritance, disposition and possession of real property by aliens ineligible for citizenship may be regulated or prohibited by law. No person shall be deprived of any right because of race, religion, national origin, or physical disability.

SECTION 9. Due process.--No person shall be deprived oflife, liberty or property without due process of law, or be twice put in jeopardy for the same offense, or be compelled in any criminal matter to be a witness against oneself.

And what due process is provided for?

SECTION 22. Trial by jury.--The right of trial by jury shall be secure to all and remain inviolate. The qualifications and the number of jurors, not fewer than six, shall be fixed by law.

There is a clear violation of Sec. 242 - Deprivation of rights under color of law

and so, Gov. Bush not only has the authority to intervene, he has the obligation!
