So then the American with Disabilities act must be unconstitutional.

Well, the road to Hell is paved with good intentions... And the ADA is an abomination.

Nice try, NO cigar...

Her brain is gone, she's as cognitive as a turnip. She'll never function again in society, and can never take care of herself. That the poor husband has waited for some resolution to this for 13 years, says a LOT about him...

Can I ask you something? Why did you bother posting on this post? You obviously have no idea what you are talking about!

So why do we keep hearing about this, from people who don't understand the reality of the situation...?

And just how do you understand the reality of the situation? Have you a medical degree of any nature? Have you watched all the videos and read all the articles? Apparently not!

Something about the husband's entitlement to a $1.6 million trust fund if she dies and it isn't spent on therapy first, makes his claims about her wishes suspect. Regardless of her condition, he shouldn't have any standing to keep her parents away from her, prohibit any attempts at therapy, etc. We'd get to the truth about her condition a lot quicker if he was out of the picture.

I had the same response on another thread. Best to just avoid these threads. One poster told me I should buzz off because the threads are for venting and not debate.

I'm TIRED of trying to explain this to you. GO EDUCATE YOURSELF AND QUITE WASTING OUR TIME.

I see your point, and how you got there.

Doesn't fly, though. (((shaking head)))

The courts have never investigated him.

Given the adverse publicity of this "case," do you think they'd let a criminal walk?

How stupid ARE you???

operating on a strictly autonomic level...

Correct. Vegetative state does not mean she's a vegetable; it means that only the vegetative state functions are working.

It is a difficult case to settle in court, because the parents don't believe that the husband is acting in her best interests.

Unfortunately, since Terry did not have a living will, her spouse is automatically her guardian, and her husband has testified that Terry did not want to be kept alive in Permanent Vegetative State.

This case has been litigated at both the state and the federal level, from the trial courts to appellate courts, to the Florida Supreme Court and the US Supreme Court.

All the judges have sided with the husband:

Tuesday, the 2nd District Court of Appeal in Lakeland, Florida, refused to block a probate judge's order to remove the feeding tube. Florida's Supreme Court has twice refused to hear the case. The U.S. Supreme Court also declined to hear it in 2001.

Michael Schiavo has collected more than $1 million from settlements and court awards, money the Schindlers claim should have been used for rehabilitative care.

Michael Schiavo says the Schindlers' comments stem from anger because they didn't receive any money from the malpractice suit.

He said 18 doctors have examined his wife in the past 13 years, that she has been to several different hospitals and even had a brain stimulator placed in her head, but showed no progress.

As you can tell, the husband denies the claims that Terry has not had the best medical care available. Sadly, Terry has not responded.

You need to go to Terrisfight.com, look at the downloads and listen to the soundclips, and then tell me she is not cognitive and is in a vegetative state. If you can look at and listen to those video and sound clips and maintain your stance, then you're a liar.

Body and mind are two separate entities. The body can be dead as a doornail with the mind operating on a different frequency. There is life there, that's all. And human life is something to be respected.

Eric, we've been closely following this case for a long time. Since you haven't, please do a simple Freep search and study the facts before lecturing those who are trying to save a disabled - NON-vegetative, innocent woman's life even as she's being starved.

All well and good- but how about the point I made above? Let's stipulate that what you posted is correct, that her brain is that gone.

Why not go in and killer her now? It would be cheaper. It would free up the bed. It would be more humane than letting her starve to death over a period of weeks-- if not more humane for her then more humane for her parents.

It is a repulsive idea; see how Ciexyz reacted to it- so adversely that my entire point was lost in the very concept.

Something in our humanity tells us that would be wrong to do.

And unless someone can make a case as to why starving someone is somehow morally superior to suffocating someone, we shouldn't act like it is.

What is being done to this woman is wrong.

This is a perfect example. After having watched some close relatives go through this, I asked my family (and they asked me) to not allow them to be artificially kept alive, if any of us got to a vegetative state, beyond any hope of recovery. The hope of recovery you refer to, it wasn't allowed to exist. The husband refused therapy. As for artificially kept alive, it's food and water. Her life support is no different than that provided to infants and other disabled people, who are unable to feed themselves. You also are making assumptions, against much proof of denial of Mrs. Schiavo's rights. You are assuming Mrs. Schiavo wants to die. You are applying your emotional attachment to your 'close relatives' situation to this case. If you truly held an emotional disconnect, unless the close relatives were your financial obligation, what would you care if they lived or died? The only evidence that Mrs. Schiavo would want to die was provided by her husband, who has a vested financial and adulterous interest in her death. Some of us see the whole of the evidence pointing toward a criminal interest in her death. In short, we see a wrong being perpetrated, not only by the husband, but by the court system. It is wrong on so many levels, culminating with the state ordered starvation of a fellow human being.
