I really don't have the stats, I know there are a lot of people in jail for drug related crimes...

No specific stats?

Then how, with any credibility, can you claim Rush's situation is at all similar to those "in jail for drug related crimes"?

I have a cousin who is an idiot... He was 17 and stopped on the side of the road to roll a joint, he got busted..

A year and a half later he got caught again, at home... pot again..

Guess what, if he get's caught again.. He'll get 7 years!!

He's a good kid, he has just done a few stupid things, and has gotten caught..

I've heard of child molesters getting less than 7 years.. Let's lock up the real criminals, how bout it..

Rush uses drugs, my cousin uses drugs... SAME THING!!!

Trafficking of Oxycontin over 28 grams carries a 25 year minimum mandatory prison sentence.

A suspect is determined to be "trafficking" in Florida based solely on the weight of drugs in the suspect's possession (more info below). IF the allegations are true, and it can be proved that Rush had a large amount of these drugs, he could be subject to a very long mandatory prison sentence, as others caught with large amounts of these drugs have been.

Weight threshold for drug trafficking Applying a significant drug trafficking decision by the Florida Supreme Court, the 2nd DCAconcluded that trafficking in oxycodone shouldbe determined by the total weight of pillscontaining the drug, not just the weight of theoxycodone itself. In affirming a conviction fortrafficking in illegal drugs, the DCA acknowledged that its decision conflicts directlywith an April ruling by the 5th DCA in Travisvs. State. Both courts were attempting to applythe Supreme Court's 1999 holding in Hayes vs.State, which dealt with how to determinewhether prescription tablets containinghydrocodone as well as a noncontrolled substance met the statutory threshold fortrafficking. The DCA noted that hydrocodone islisted on both Schedule II and Schedule III, butoxycodone is only a Schedule II drug andtherefore should be treated differently. "Variousprescriptions drugs ... containing a mixture ofoxycodone, which is listed only on Schedule II,and a noncontrolled substance (usuallyacetaminophen) are to be measured by theiraggregate weight in determining whether atrafficking amount is present," the DCA said.Assistant Attorney General Tonja R. Vickersrepresented the state on appeal.[Eagle vs. State, 7/7/00]
