Yes they are. You might want to try learning the facts before pontificating on them.

If they are, they're arguing from the wrong direction.

Arguments in law are extremely weak in these cases.

Arguments in equity are the weapon of choice here.

Any first-year law student would know this.

This is the 3rd (at least) time i've heard you say this. Could you please give an example of an "argument in equity?" As it would pertain in this case.
