They've simply declined jurisdiction, or refused to hear the case altogether. Not sure they are privy to all pertinent info in that situation, are they?

Remember the Elian case?

I think I heard those objections before.

Refresh my memory - what happened in the Elian case that parallels this one? I wasn't so politically aware back then and hadn't yet discovered FR.
