Was Rush a drug dealer or a drug user? Each state is different.

If Rush was a drug dealer in Florida, he will go to jail. If Rush was a drug user, Florida is lenient over non-violent first time offenders. He will go through Drug Court. Florida thinks its better to rehabilitate than to incarcerate. He would go through a drug rehab program and be monitored by the court for a period of time. If he stays clean and graduates from the program, the court will drop the charges.
That's if Rush is charged for using drugs with no intent to sell.

The point I am trying to make is whether he is tried or not, jailed or not, IF he has done what has been reported it was a crime, a criminal act. No matter what legally happens to him, IF he did what the papers and tabloids have said he may have done, then he is a criminal.
