Yes he probably is, but that is not the way a liberal leaning Federal Appeals Court would rule. Chances are the Supreme Court would now dead lock 4 to 4 and the lower courts ruling would stand.
It does not matter what is right or wrong. The simple arithmetic is now working against Ted Cruz.
