In fairness, Reagan never intended to pass such a liberal abortion law. The bill he signed was known as the Beilenson bill. It legalized abortion if the mother’s health was in danger. It was sold to the legislature, and to Governor Reagan, as applying only in a few extreme cases where physical trauma was present. Lyn Nofziger said Reagan only signed it after being assured of this. However, after the fact, the word “health” was interpreted as applying to anything, such as women’s “distress” over being pregnant.

It resulted in abortion-on-demand, but that was never Reagan’s intention. For years afterward, he was accused of flip-flopping on abortion and of having been “pro-choice” as governor. That was an unfair characterization. Judicial activism of the type we saw unleashed in the 1970s on abortion had not yet become the norm when Reagan signed the bill. Pro-lifers later learned that the word “health” was a loophole big enough to drive a tank through, but Reagan had no idea of that at the time of the signing.
