No, but the legal standard for violating the statute is what would a reasonable person think, if Obama were charged with a violation he would insist on a jury trial and make sure the jurors were all Republicans, thereby assuring that all most all of them would be reasonable.

• You're implying that Obama would be reasonable to select an all Republican jury to render and impartial decision in his favor.
• You are saying that all Republicans are reasonable.
