Republican gubernatorial candidate Jerry W. Kilgore began airing two television ads yesterday featuring the loved ones of murder victims and attacking Democrat Timothy M. Kaine for his opposition to the death penalty.
Kaine talks about the death penalty
Question: You couldn't conceive of a case where a person, because of his behavior and criminal conduct, deserved the death penalty? What about Adolf Hitler? Do you think he should be executed? Should have been executed?
Kaine: Well...I don't think it's needed to be safe.
Translation: Hitler, Stalin, Idi Amin, (Osama?) don't wouldn't merit the death penalty in Tim Kaine's book.

U.S. District Judge Henry Hudson yesterday dismissed a lawsuit designed to overturn Virginia's open-primary law.
I thought they filed during the primary season. I could be wrong. But the article mentions Senator Steve Martin. Steve's a friend and my Senator. But I was highly annoyed that I got a fundraising leter from him yesterday when his election is two years away. I intend to tell him so.

Republican gubernatorial candidate Jerry W. Kilgore yesterday continued pressing rival Timothy M. Kaine on the death penalty, enlisting four GOP prosecutors to challenge Kaine's uncertainty over the deterrent effect of capital punishment.

Progressives around the state are shocked -- shocked! -- that a campaign advertisement by Jerry Kilgore does not capture all the exquisite nuances of Tim Kaine's excruciatingly intricate position on capital punishment. In the ad, a man whose son was murdered by one of Kaine's legal clients takes a Kaine quote out of context to suggest Kaine believes "Adolf Hitler doesn't qualify for the death penalty."

Kilgore, the former attorney general, collected almost $2.8 million in September, giving him nearly $5.3 million in cash as the race enters its final crucial phase, according to information provided to The Times-Dispatch yesterday and which is due Monday at the state Board of Elections. Kilgore continues to hold a fundraising edge over his rival, garnering more than $16.7 million as of Sept. 30.
Kaine, the lieutenant governor, raised $2.2 million last month - almost the same amount he garnered in July and August combined. He began October with close to $5.2 million in his treasury and had raised more than $15.3 million as of the end of September.

"The momentum is just clearly growing," said Kilgore spokesman Tim Murtaugh. "We feel very good about where we are, and we will most certainly have the resources to spread our message to all Virginians through the election."
First lady Laura Bush appeared at a McLean fundraiser on Wednesday, generating about $750,000, which wasn't included in the September report. Vice President Dick Cheney will headline a fundraiser on Monday.

FAIRFAX -- Top presidential adviser Karl Rove, who spent more than four hours testifying before a grand jury Friday, was a no-show yesterday at a political fundraiser where he had been billed as the featured speaker.
"Had we known he wanted to invite Bill Clinton, let me assure you, I would have sprung for the airfare," Kilgore said.

I was there! It was a great line. Ken Mehlman stood in Karl Rove's stead and explained how important this race is to the White House. Mehlman said a strong GOP showing will impact how successful President Bush is at home and around the world in trying to implement his second term agenda. He also reminded us how Fairfax County is the Ohio of the 2004 election. There is a lot of apathy out there so it will all come down to who motivates their people and gets them to the polls.
