It is wrong to use some constitutional provisions as springboards for major social change while treating others like senile relatives to be cooped up in a nursing home until they quit annoying us. As guardians of the Constitution, we must be consistent in interpreting its provisions. Ah, if only all of our judges had this attitude.

The big question is will the Supreme Court take this case. that is a very big unknown. Four justices must vote to greant cert. Now perhaps these could be four liberals who wish the Second to go away and think tthey have sufficient votes to accomplish this or perhaps four conservatives who seek to enforce the RKBA. Anyone who says they know what will happen is a liar.

where will the justice department fall on this. Bush could generate some political capital with this.

Indexing. Read these dissents (even in the 9th circus!) about the Second Amendment being an individual right!
(FP: The asterisk is necessary for the bang_list.)

The Justice Department will if they become involved at all ask the Supreme Court to pass this case by.

I am compiling a list of FreeRepublic folks who are interested in RKBA topics. If you want off my ping-list, just let me know.
Conversely, FReepmail me if you want to be added.
And my apologies for any redundant pings.

I'll be very dissapointed but not surprised if the Justice Department tries to stop it from being reviewed.

Excellent! Thanks for the post, Happy2BMe!

"Read these dissents (even in the 9th circus!) about the Second Amendment being an individual right!" When the 2nd Amendment was written, the legitimacy for it's existence was unquestionably logical and unanimous throughout the land.
So was the right of a baby to live once it had been concieved.

"Excellent! Thanks for the post, Happy2BMe!" This new despicable anti-American precedent by the 9th circus is so important to all of us. Their unity in continually attacking the foundations of this nation (e.g., it is unconstitutional to mention the name of Almighty God in the National Pledge of Allegiance) cannot go unanswered - they have a plan and it is NOT a good one.
On the one hand it further demonstrates the 9th's fervent agenda to dismantle even the basest of our Constitutional rights.
On the other hand, the dissent within the ranks of the 9th over the levity of retracting the Second Amendment rights of individual citizens to arm and protect themselves speaks volumes for the hypocrisy within their fold.
The 9th needs some series house-cleaning by John Ashcroft - and time is NOT on our side!

"Now perhaps these could be four liberals who wish the Second to go away and think tthey have sufficient votes to accomplish this or perhaps four conservatives who seek to enforce the RKBA. Anyone who says they know what will happen is a liar." Regardless of how you shake it or bake it, the 9th Circuit Court of Appeals is a major force for liberal change to our fundamental Constitutional rights. They don't appear to have any indication or reason to waver from this course.
